PURCELL, Oklahoma -- Ten days after Katrina Griffin and her two children were found dead in a burnt-out mobile home, the main suspect remains in jail, even though he has yet to be charged with any crime.
Shaun Bosse appeared at another court hearing Monday that sometimes got heated concerning the further delay.
Bosse's attorney said the Oklahoma State Bureau of Investigation and the D.A. rushed to judgment.
"I believe that if they had evidence to file, charges would have been filed," said Bosse's attorney Gary Henry. "I can only assume by no charges, they have concerns. And, if they have concerns, then my client is being illegally detained."
Prosecutors asked the judge to give them until Friday to file. They say Alcohol, Tobacco and Firearm agents will be back at the crime scene Tuesday to continue the investigation.
The judge gave them till Friday.
NEWS 9's legal analyst Irven Box understands why the state is being cautious.
"This is a case, probably will be one where they will ask for the death penalty," said Box. "The D.A.'s office here wants to be sure they have all their 'I's dotted, all the 'T's crossed."
During a discussion of bond, Bosse's mother, Verna Bosse, took the stand to answer a question about Bosse's relationship with Katrina Griffin.
"I don't even know her," said Verna Bosse. "I mean, I had never met her. I never knew anything about her."
Bond was denied. But the judge imposed a gag order and ordered the OSBI to take down a Web page that includes information from the still-sealed probable cause affidavit.
"At this point the judge has issued a gag order," said Cleveland County District Attorney Greg Mashburn. "I will honor that, of course, and I don't want to run afoul of her ruling at this point. So, I'll just have to wait until we get our charges filed on Friday."
But if charges aren't filed by 4:30 p.m. Friday, the court will hold a habeas corpus hearing. That would force the state to reveal what evidence it has that links Shaun Bosse to the crime.
The OSBI said it will comply with the judge's order and won't offer any other comment because of the gag order.
