Oklahoma prosecutors charge man

OKLAHOMA CITY (AP) - An Oklahoma City man charged in the beating death of a dentist in North Dakota now faces a fugitive from justice count in his home state.

Oklahoma County prosecutors filed the charge Wednesday against 63-year-old Gene Kirkpatrick, who already has been accused of conspiracy to commit murder and burglary conspiracy in North Dakota.

Authorities have alleged that he paid his handyman, Michael Nakvinda, to kill his son-in-law, Philip Gattuso. Investigators say Kirkpatrick didn't like the way Gattuso was raising his grand-daughter since Gattuso's wife - Kirkpatrick's daughter - died.

Nakvinda has waived extradition to North Dakota, where he is charged with murder.

Kirkpatrick was arrested Monday and refused to waive extradition during a court hearing on Tuesday.

The refusal was cited in a probable cause affidavit accompanying the charge.
