Victim's Mother Leaves Courtroom In Tears During Tulsa Teen's Murder Trial

TULSA, Oklahoma -- The jury could begin deliberating Friday in the murder trial of Theo Fleming, who is accused of killing his girlfriend Kaitlyn Finnegan in 2009.

News On 6 reporter Lori Fullbright was in the courtroom again on Thursday.

A friend of Theo and Kaitlyn's testified Thursday that the couple was getting along just fine moments before he heard the gun shot. This witness kept sighing and putting his head down and saying he was freaking out just having to talk about it.  At one point he said "you have to understand this is very hard on me and on Theo too."

That's when Kaitlyn's mother, tears streaming down her face, had to leave the courtroom for a few minutes. Listening to the details of Kaitlyn's death over and over has been devastating for her family.

This same witness admitted he picked up the spent shell casing with a rag and moved it to the kitchen and agreed to initially lie to police and say it was a drive-by.

Another witness, who was not at the shooting, told the jury he heard from someone who was there that Theo and Kaitlyn were arguing and Theo said he was going to shoot her right before he did.

The defense pointed out this is the same kid who beat up Theo the night before and was the reason Theo had bought the gun.

Police frequently say young people just don't get how dangerous guns are.

That was obvious in court when a prosecutor asked one of the teenagers at the shooting why he was so surprised Kaitlyn died. The teenager said because on the TV show Law and Order, only the people who are bleeding a lot die and Kaitlyn wasn't bleeding, just convulsing.

Prosecutors have to wonder how many more of these tragic cases it is going to take before kids realize real life is not TV.
