TULSA, Oklahoma – The lawsuit against the Tulsa City Council was dismissed Thursday.
According to court records, Burt Holmes, Nancy Rothman and Henryetta McIntosh dismissed the lawsuit because it "no longer serves the best interests of the citizens of Tulsa."

Holmes, Rothman and McIntosh claimed the council violated Oklahoma's Open Meeting Act during its meeting on June 17, 2010.

During that executive session, the council discussed its investigation into Tulsa Mayor Dewey Bartlett and his Chief of Staff Terry Simonson. The investigation concerned federal grant money used to re-hire Tulsa Police officers.
The council excluded Mayor Bartlett from that meeting, but Holmes, Rothman and McIntosh said the council had no legal right to do so.
Despite the dismissal, court records show Holmes, Rothman, and McIntosh believed the lawsuit succeeded in "raising our elected officials' awareness of the important policies and values embodied by the Open Meetings Act."
