New Details Released in Sexual Assault Case Involving Ponca City Wrestlers

Police have released new details and affidavits in the sexual assault case against two state champion wrestlers at Ponca City High School.

PONCA CITY, Oklahoma -- Kay County officials released the affidavits for two Ponca City state champion wrestlers both accused of sexual assault involving teens under 16 years old.

Police said they received a report of sexual assault on Thursday, November 4 involving a minor. The next day, Devin Aguirre, 18, was arrested on a complaint of lewd acts with a child under 16.

In a police affidavit, Aguirre admitted to having sex with a 14-year-old girl in a vehicle in front of his relative's house.

Ponca City Police Cpt. Don Bohon said the investigation has led to a subsequent request to change the possible charge to second-degree rape.

No charges have been filed against Aguirre at this point.

Ponca City Police said they received another separate report of a sexual assault involving a minor that had occurred two weeks prior to the report. On Friday police arrested Austin Legg, 18, on a complaint of second-degree rape.

The 14-year-old victim told police the alleged sexual assault involving Legg occurred in a building next to the Ponca City High School's cafeteria. Legg denied the incident ever took place.

Ponca City Public Schools Superintendent David Pennington said the recent allegations made by the 14-year-old victim in Legg's complaint stating the incident took place on school grounds changes the dynamics of the situation.

In a statement released by a spokesperson for the Ponca City Public Schools Superintendent, “?it’s alleged this took place on the school’s property and it will now require an internal investigation by the school district?if a violation on school property is determined, disciplinary action will be taken.”

No charges have been filed against Legg at this point.

Pennington said both Legg and Aguirre are seniors at the high school and the two victims are freshmen. He added that everything is being done to make sure the school day is as normal as possible for all 1,500 students in light of the recent arrests.

Pennington also said all steps are being taken to make sure there is no contact between the parties involved in the hallways or anywhere else on school property.
Pennington said Aguirre and Legg are innocent until proven guilty and no suspensions have been made at this time.

Both Aguirre and Legg are members of the school's State Champion wrestling team.

Police wanted to make it clear that Aguirre and Legg were arrested for separate incidents, involving separate people, occurring at separate location at different times.
