New Suspect Named In Child's Sexual Assault; First Suspect Freed

CREEK COUNTY, Oklahoma -

The Creek County Sheriff's Office said Friday that a suspect arrested in the sexual assault of a 4-year-old girl in April was released from jail last week, after being cleared by DNA evidence.

Tommy Braden, 24, was the boyfriend of the girl's mother. He was the one who called the police to report the assault.

Creek County Undersheriff John Davis said Braden was cleared of any involvement through DNA evidence. He said they had a new suspect in the case, through a DNA match.

Braden was arrested after the 4-year-old girl was assaulted on April 6. The girl's mother was not home at the time of the attack. Only Braden, the girl, and a younger child were in the home.

Police found the window in her bedroom broken. Also, the family's dog had been stabbed and was thrown in a neighboring yard.

Initial results cleared Braden, which is why he was released, but Monday, confirmation of the results further cleared him.

OSBI confirmed the new suspect in the case is identified as Patrick Misner, 27.

Misner was arrested on July 7 by the Gresham Police Department in Oregon. He was taken to the Multnomah County Jail, where he was booked on a misdemeanor and released within two hours.

The sheriff's office said records show Misner lived in the same mobile home park as the victim at the time of the assault.

Misner has not been charged, but the Creek County Sheriff's Office has outstanding warrants for him on rape, burglary, and lewd molestation.
