Lifetime Sex Offender Takes Stand In Kingfisher County Court

Matthew Mallory is charged with five counts of child abuse. Police caught him in Texas in April of 2011 after investigators say he ran away with his 14-year-old niece.

A lifetime registered sex offender accused of having sex with his 14-year-old niece wants to withdraw his guilty plea.

Matthew Mallory is charged with five counts of child abuse. Police caught him in Texas in April of 2011 after investigators say he ran away with the girl.

Mallory entered a guilty plea on August 7, but sent a letter to the judge on August 17 that he wanted to withdraw that plea.

During a court hearing in Kingfisher County on Wednesday, Mallory took the stand. In his testimony, Mallory told the judge he wants to withdraw his plea because he was under the influence of meth when he agreed to the plea deal. He said, under oath, that he also feared being green lighted and being assassinated in prison.

"I was afraid to die," he said in court.
