Former Broken Arrow Superintendent Reaches Deferred Prosecution Agreement

TULSA COUNTY, Oklahoma -

Former Broken Arrow Schools Superintendent Jim Sisney and Windstream Communications reached an agreement of deferred prosecution Wednesday, in a Grand Jury investigation into bribery and conspiracy.

Sisney is accused of accepting gifts from Windstream Communications in exchange for influencing the school district to do business with the company.

Under the terms of the deal, the state will not file charges if Sisney agrees to not seek employment again as a school administrator and to pay $9,500 to the Broken Arrow school Foundation, which he cannot claim as a tax deduction.

Windstream must also pay more than $100,000 to the school foundation and create a code of ethics by which to train employees.

"We are pleased to reach an agreement with the state of Oklahoma to dismiss these charges," said John Fletcher, executive vice president and general counsel for Windstream. "We have denied the charges from the beginning and cooperated fully with the investigation. As always, our focus remains on conducting our business with integrity."

The indictment against Sisney alleged he accepted two all-session tickets to the 2007 NCAA Men's Final Four in Atlanta, "with the promise of other valuable gratuities," paid by Windstream Communications, which was also named in the indictment.

Sisney was suspended by the school board in October 2008.
