HASKELL COUNTY, Oklahoma -

The Haskell County district attorney has dismissed child abuse charges against a Stigler woman in her 8-month-old son's death but says the state plans to re-file the charges after an expert witness recovers from a medical condition.

Randi Lunceford's trial was to start this week.

Lunceford's son was reportedly in her care when he suffered a series of injuries over his short life span, including brain injuries and broken bones. He died in July, 2011, after investigators say his mother turned off equipment monitoring his tracheotomy and feeding tube.

An expert witness was unable to attend the trial due to medical issues, and District Attorney Danita Williams said the state did not want to proceed without the expert's testimony. The state dismissed charges without prejudice, meaning they can be re-filed as soon as the witness is able to travel.

Lunceford's attorney says there is no evidence of abuse.

The state had filed a motion for a continuance, but the motion was overruled.
