Oklahoma Court Dismisses Bartlesville Police Video Appeal

BARTLESVILLE, Oklahoma -

The Oklahoma Court of Civil Appeals has dismissed an appeal filed by the city of Bartlesville over a Washington County judge's 2012 order that it release a video allegedly showing two police officers assaulting a patient in the hospital's emergency room.

The court handed down the ruling Wednesday.

It affirms Washington County District Judge Curtis DeLapp, who ruled last year the videotape "is a record under the Open Records Act" and must be made available to the Bartlesville Examiner-Enterprise because it contains facts about the arrest.

The newspaper sued the police department over the tape, which it believes shows two officers assaulting a handcuffed man at a hospital in September 2011.

The newspaper said the city denied an Open Records Act request in the case.

After it was release, NewsOn6.com posted a 5-minute segment of the video.

Washington County District Attorney Kevin Buchanan did not immediately return a call seeking comment.
