A convicted felon is facing first degree murder charges Wednesday night. He's accused of shooting and killing a man late last month.

But those who knew the victim say it was a fight between the two that lead to the deadly shooting.

The victim's father-in-law who says the victim was like a son to him, can't believe he's gone. He tells News 9 the victim actually beat up the accused killer, after discovering he'd spent the night with his wife.

It happened outside the home of Donald and Candie Nelson the morning of November 25. Police were called to the home on S.W. 22nd Street after getting a 911 call for help.

When they arrived they found Donald Nelson dead inside. An autopsy report released Wednesday shows he had been shot once in the chest.

Now, John Michael Torren is facing a charge of first degree murder for that deadly shooting. Court papers state Torren shot Nelson with a "9 millimeter" inside his home. The arrest warrant reveals Nelson's wife, children and one of the children's friends were all inside the house at the time.

The arrest warrant also reveals Candie Nelson admitted to having marital difficulties with Donald and that they had recently had a fight where he assaulted her and then left the home.

It states Torren, identified as a friend of Candie's, came over the next day and stayed the night. It states the next morning, Nelson came back to the home and confronted Torren in a back bedroom and then a physical confrontation ensued. That's when a single shot was fired.

The report states after the shooting, Torren took off before police could arrive. But The Metro Fugitive Task Force found him in Del City and booked him into jail on December 2.

News9 talked with Candie Nelson late Wednesday afternoon by phone. She says she knew Torren, but that he was not her boyfriend and feels he did not need to shoot her husband.

She says her husband was a good father who lived for his family. Turns out Nelson had just been released from prison in November, after serving time for drugs and stealing copper.

Torren had also just been released from prison last month, after doing time on several drug convictions. He is now being held in the Oklahoma County jail without bond.
