Lawyers for Tulsa County clerk Sally Howe Smith are appealing a federal judge's ruling that says Oklahoma's amendment banning same-sex marriage is unconstitutional.

They filed a three-page notice of appeal on Thursday.

Howe-Smith was named a defendant in the case after she refused to issue a marriage license to a gay couple.

The judge said when he made the ruling it wouldn't go into effect immediately, because he expected it to be appealed.
