Dozens of federally-filed Lipitor lawsuits (http://www.thelipitorlawsuit.com/ ) that allege the statin drug caused patients to develop Type 2 diabetes have been consolidated in a multidistrict litigation and transferred to the U.S. District Court, District of South Carolina, for pretrial proceedings. According to an Order issued by the U.S. Judicial Panel for Multidistrict Litigation (JPML) on February 18, 2014, the new multidistrict litigation will consist of 56 product liability claims that allege a connection between Lipitor and diabetes. However, the Order noted that as many as 170 tag-along actions could also be transferred to the proceeding. In addition, all Lipitor lawsuits involving diabetes allegations that are filed in federal courts in the future will likely be transferred to the District of South Carolina. Lipitor Diabetes Allegations
According to court documents, all of the Lipitor lawsuits pending in the newly established litigation claim that patients developed Type 2 diabetes as a result of taking the medication. Plaintiffs further allege that Pfizer Inc. failed to adequately warn patients and doctors about the link between Lipitor and diabetes, and was negligent, careless and/or reckless in its marketing of the cholesterol-lowering drug. The establishment of the multidistrict litigation for Lipitor diabetes claims will allow these lawsuits to undergo coordinated pretrial proceedings, which will eliminate duplicative discovery, inconsistent court rulings, and preserve the resources of the court, parties and witnesses.
Lipitor lawsuits have been mounting since February 2012, when the U.S. Food & Drug Administration (FDA) ordered the manufacturers of statin drugs to add new warnings to their labels regarding their effects on blood sugar levels. The FDA action followed the publication of a study the prior month in JAMA: Internal Medicine, which reported that post-menopausal women treated with drugs like Lipitor were at increased risk of developing new-onset Type 2 diabetes. *
This past May, the British Medical Journal also reported an association between Lipitor and diabetes, finding that patients who took the drug had a 22 percent increased risk of new-onset diabetes.**
