TAHLEQUAH, Oklahoma -

A fatal police shooting in Tahlequah is under review by the District Attorney's Office. Cherokee County Assistant District Attorney Jack Thorpe says he's received the Oklahoma State Bureau of Investigation's report on the death of Joshua Crittenden and will be reviewing the findings this week.

Tahlequah Police Officer Randy Tanner shot and killed Crittenden June 27, 2015, after responding to a call of two men with weapons fighting in the 500 block of South Mission. Investigators said the 35-year-old Crittenden was involved in an argument outside a residence then hid in a nearby house when police arrived.

He was shot when he jumped out of an attic with a gun drawn and pointed at Officer Tanner, according to police.

Body cam video from another officer showed part of the incident although Tanner did not have his body camera activated. Police Chief Nate King said Tanner, an arms instructor with the department, was at the scene primarily as an observer and did not think to activate his camera when the incident escalated.

Crittenden was shot six times and died at the scene. Tanner has been on leave pending the outcome of the investigation.
