DA: No Charges Against Tahlequah Officer In Fatal Shooting

TAHLEQUAH, Oklahoma -

The District Attorney's office said it won't file charges against a Tahlequah police officer who shot and killed a man in June.

Officer Randy Tanner shot Joshua Crittenden on June 27, 2015 when Crittenden, 35, jumped out of an attic and pointed a gun at Tanner, according to police.

Tahlequah Police Chief Nate King said Wednesday that the department's internal investigation cleared Tanner and that Tanner had returned to work. On Thursday, August 13, 2015, First Assistant District Attorney Jack Thorp sent a letter to the Oklahoma State Bureau of Investigation informing it that he declined to file charges against Tanner.

Tahlequah Police had requested the OSBI's help in investigating the incident.

"It is my opinion that Tahlequah Police Officer Randall Tanner was justified in the use of deadly force against Joshua Crittenden on June 27,m 2015, in Tahlequah, Oklahoma. Because of this belief, I decline to file charges against Tanner," he wrote.

Tanner is a 15-year veteran of the department. Thorp noted in his letter that they had gone to the home where the shooting happened on a "fight with guns" call.
