State Attorney General Charges Five Oklahomans With Insurance Fraud

Insurance fraud charges have been filed in four separate cases out of Cherokee, Delaware and Oklahoma Counties, state Attorney General Scott Pruitt announced Wednesday. 

Darian Kent Davis and Deavan Shay Davis, of Delaware County, are believed to have conspired together in order to submit an insurance claim for a damaged vehicle, in which the damage had occurred before an insurance policy had been purchased, Pruitt said.

Darian Davis and Deavan Davis each face one count of conspiracy to commit a felony. If convicted, each could face up to 10 years in prison and face fines of up to $5,000.

Deavan Davis was also charged with one count of false claim for insurance. If convicted, Davis could face an additional three years in prison and face fines of up to $1,000.

John B. Ballard, 23, of Cherokee County, allegedly submitted a false insurance claim reporting his truck had been damaged in an accident, but the accident happened prior to Ballard purchasing insurance. 

Ballard faces one count of fraudulent claim upon insurance contract for payment of loss. If convicted, Ballard faces up to three years in prison and fines of up to $1,000.

Bang Kinh Bui, 30, of Oklahoma County, allegedly submitted a false insurance claim reporting his truck and trailer were stolen from his home, but Bui didn't purchase the insurance policy until after they were stolen.

Bui faces one count of false claim for insurance. If convicted, Bui face up to three years in prison and fines of up to $1,000.

Tiffany Shanae McManus, 29, of Oklahoma County, is alleged to have falsely reported damage to her vehicle that she had already reported to a different insurance company.  An investigation by the Attorney General’s Office showed the damage reported in both claims to be identical.

McManus faces one count of false claim for insurance. If convicted, McManus faces up to three years in prison and fines of up to $1,000.
