Tulsa Police arrested a man accused of shooting and killing his girlfriend.

Police said he told them he thought she was an intruder, but investigators said his story doesn’t match up with Oklahoma’s make my day law.

Officers were called to the home near West 1st Street and South 35th West Avenue at about 3 a.m.

Sabrina Meier, 20, was found dead on the front porch of her boyfriend Xavier Dixon's home after he said he thought she was an intruder.

Dixon is now behind bars on complaints of first-degree manslaughter.

Police said Dixon, 21, heard someone at his window around 3:00 a.m. when he fired several rounds into the window.

Police said Oklahoma's make my day law does not apply because of the way the shooting happened.

"Because of the way this whole thing transpired, I guess detectives just didn't feel like he was really in fear for his safety," said Jeanne MacKenzie, with Tulsa Police.

According to investigators, Dixon initially said he'd shot through the window and then called the police.

After some questioning, however, police said Dixon admitted to walking outside and shooting the woman several more times before realizing it was his girlfriend and then calling the police.

"If he had stayed in his residence and called 911 this might have panned out differently for him," MacKenzie said.

Police also said Meier texted Dixon about an hour and a half before the shooting, saying that she wanted to come over. They said he texted her back saying he wasn't home.

The investigation is still ongoing and charges will be up to the District Attorney's Office.

"The D.A.'s office could look at the investigation and they could decide one way or another," MacKenzie said.

Meier leaves behind a 1-year-old daughter that just had a birthday Tuesday.
