Judge To Decide Next Week If Bixby Rape Suspects To Be Tried As Juveniles

<p>A judge will make a decision by Monday, September 10th, whether four Bixby football players accused of sexually assaulting a teammate will be tried as as adults or sent to the juvenile system for treatment.</p>

A judge will soon decide whether to move the case against four Bixby football players accused of rape to juvenile court.

If the judge agrees, the players would likely get counseling and the records would be sealed.

Attorneys for the four young men said it's not just their opinion the teenagers should be sent to juvenile court, it's the opinion of psychologists and even the office of juvenile affairs.

Joe Wood, Colton Cable, Samuel Lakin and Will Thomas are currently charged as youthful offenders. If their case is moved to juvenile court, the four would likely get out of custody counseling for a period of months.

Attorneys said the four are the perfect candidates for treatment under the law for reasons that include they have no criminal history, their testing shows they have a low risk to commit other crimes, they had no sexual intent and the victim had no physical injuries.

Wood’s attorney, Paul DeMuro said, "All the evidence shows this case belongs in the juvenile system."

"We look forward to these boys getting their lives going forward, and also to the young man who went through this, we wish the best for him and mean that sincerely," said Lakin’s attorney Clark Brewster.

Prosecutors are against it and argued there was a culture of bullying within the Bixby football program that resulted in the rape of one of the bullying victims.

They told the judge the assault was aggressive, violent and premeditated, and although the victim did not have physical injuries, he does have psychological injuries.

They argued the suspects were charged as youthful offenders, so, if found guilty, should be sentenced as youthful offenders.
