The attorney for the family of a 16-year-old boy who was shot and killed by Bixby police says he was murdered.

An attorney for Logan Simpson's family tells us the dash cam video shows the teen driving away from the officer and not toward him when he was killed.

Officer Jon Little's attorney says the officer fired his weapon because he feared for his life. The family's attorney says on July 22nd Logan's mom called Bixby police because someone was attacking his brother with an ax.

At some point in the commotion, they say Logan left the house in his car. That's where the Dashcam video picks up.

When police spotted the vehicle, they say Logan wouldn't stop and eventually turned around and started driving towards Officer Jon Little.

Officer Little's attorney Scott Woods, says Officer Little believed the person driving was the suspect from the ax assault and he drew his gun and opened fire.

"A family member of the victim ends up being shot and killed, it's horrible but officer Little was justified in what he did under the circumstances," said Wood. "Officer Little's got a better view than that dash camera, and when he decided to use deadly force he believed that he was about to get run over."

Simpson's attorney, Kevin Adams says, the family is aware that Logan should have stopped the car and not have driven away from police but says that mistake should not have cost the teenager his life.

"That's the only thing he did that he shouldn't have done is he didn't stop when he was supposed to. He certainly didn't deserve to die for it," said Kevin Adams.

Wood says because the officer believed the person driving was instead the suspect from the ax assault, he drew his gun.

"That information that it was Logan who had taken that car. That information had not made it to officers at the scene and certainly had not made it to officer Little," said Wood.

"He didn't have to kill that kid, and there's no justification for that from what we could see from the video," said Adams.

Court dates have not yet been set for the lawsuit.
