Charges thrown out against Tulsa school teacher

WAGONER, Okla. (AP) -- Drug charges against a Tulsa Union teacher and his wife were dropped after a judge threw out a search warrant.

Keith and Kim Eidson of Wagoner were charged in August in Wagoner County with unlawful cultivation of marijuana.

Associate District Judge Shepherd threw out the search warrant yesterday because the Eidsons didn't consent to officers searching their property.

Richard O'Carroll, the Eidson's attorney, says the case was dismissed with prejudice, which means charges can't be refiled.

Authorities found 49 marijuana plants from 6 feet to 12 feet tall at the Eidson's residence, marijuana in vacuum-sealed packages, seeds, pipes and paraphernalia.

Keith Eidson, who has taught at the Tulsa Union School District for 20 years, was suspended with pay pending the outcome of the case. He is expected to return to work.
