Carruth Must Allow Home To Be Sold

CHARLOTTE, N.C. (AP) — Rae Carruth's $237,000 home may be sold and his NFL retirement account liquidated to pay child support for his 6-month-old son.

The former Carolina Panthers receiver and three others are accused of plotting the Nov. 16 drive-by shooting of Cherica Adams.

Soon after, she gave birth to a boy, Chancellor Adams; Carruth is the boy's father. Cherica Adams died of her wounds Dec. 14.

Adams' parents, Saundra Adams and Jeffrey Moonie, have sued Carruth for custody of Chancellor and for child support. Saundra Adams has temporary custody.

Judge Yvonne Mims Evans said Carruth failed to show his previous lawyers misled him into signing papers authorizing the court overseer, Elizabeth Hodges, to sell his home and liquidate the retirement account.

Evans' decision means Hodges can complete an inventory of Carruth's assets. The judge gave her authority to put Carruth's home up for sale and to liquidate his 401(k) retirement account from the NFL, valued at $21,808.

Evans' decision was revealed in a May 10 memo to the lawyers involved in the child support and custody case. The memo also said Evans intends to deny the motion to remove Hodges.

In February, Carruth agreed to Hodges' appointment in the child support case. But after hiring new lawyers, Carruth sought her removal, saying he signed the agreement without fully understanding it.

The judge's memo doesn't say when or if proceeds from Carruth's home and retirement account will be given to Adams' parents. Also unresolved is whether Cherica Adams' mother can sell several of Carruth's cars to raise more child support money.

Hodges has said without unrestricted access to Carruth's residence, she could not list the house for sale or inventory Carruth's personal property.

``I hope now that the parties will cooperate with Ms. Hodges,'' the judge wrote in her memo. ``Arrangements should be made for her to enter Mr. Carruth's house, accompanied by persons acting on his behalf such as his attorneys, family members or agents.''
