AG names district attorney to review case against former Creek County judge

Updated:
OKLAHOMA CITY (AP) _ The district attorney for Pottawatomie and Lincoln counties is selected Tuesday to determine whether criminal charges should be filed against a former Creek County judge.

Attorney General Drew Edmondson Tuesday asked Richard Smothermon to review the case against former Judge Donald Thompson.

Creek County District Attorney Max Cook recused himself from the matter. In a letter to Edmondson, Cook cites the fact that he was listed as a witness in a possible ouster case against Thompson.

Thompson retired effective September 1st amid allegations of sexual misconduct while on the bench. Attorney General Drew Edmondson had sought Thompson's removal before Thompson resigned.

Smothermon is charged with determining whether a criminal action has occurred and if charges are warranted.
