MUSKOGEE, Okla. (AP) - Former state Senator Gene Stipe won't be reporting to a prison hospital on Friday for treatment to help restore his mental competency as originally scheduled. Stipe's attorney has filed an appeal of a judge's order sending Stipe to the prison for treatment and says it could be a year-and-a-half before a ruling is issued.

Gene Stipe will remain confined to his home in McAlester in the meantime and is under electronic monitoring by the U.S. Probation Office.

Judge Ronald White ordered the treatment after a forensic psychologist who evaluated Stipe at the federal prison in Springfield, Missouri, said Stipe has severe dementia. White ordered the mental exam during a hearing in which federal prosecutors were asking to revoke Stipe's probation on convictions for perjury and violating campaign finance laws.
