Judge Upholds Sand Springs In Quarry Fight

A Tulsa District Court judge upheld the City of Sand Springs' denial of a permit to build and operate a quarry.

SAND SPRINGS, OK -- New developments in the city of Sand Springs' efforts to stop a limestone quarry. 

A Tulsa County District Court judge has upheld the city's denial of a permit to build and operate the quarry. 

Neighbors living near Avery Drive and West 41st Street have been fighting the quarry.  They say it's environmentally dangerous and would lower property values. 

Sand Springs Materials LLC asked for permission to dig the quarry last fall, but the city planning commission turned them down. 

The Sand Springs city council agreed with the planning commission.

"This matter may not yet be concluded, but we have earned a significant victory," said Sand Springs Mayor Bob Walker. "It affirms the SUP process that has been laid out both in State law and City ordinance; it recognizes the time and effort of our citizens throughout this process; and it validates the thorough consideration given to this application by the Planning Commission prior to reaching its decision." 

The developer can still appeal the Tulsa County court ruling to the Oklahoma Supreme Court.
