TULSA, OK -- A Tulsa man accused of trying to kidnap a woman and her daughter will stand trial.

After hearing evidence in the case, the judge decided 33-year-old Allen Shields should stand trial on several charges including kidnapping and assault and battery.

The woman's 9-year-old daughter testified Thursday about making a call to 911 on February 8th.

She told a dispatcher someone was trying to kill her mom.  When the dispatcher asked her who, she said it was her mom's ex-boyfriend, Allen Shields.

Police say the girl barricaded herself in her bedroom after Allen Shields broke into her house and pepper-sprayed her mother.

"I think the evidence is clear the police breached the door and saved two lives," said Tim Harris, Tulsa County District Attorney.

Shields is accused of having a 'homicide starter kit' that included a gun, a mask, handcuffs and sleeping pills.

His lawyer says many of the items were already in the victims' home.

"It's baloney, it's just baloney," said Jim Linger, Shields' attorney. "Go out and try to buy a homicide kit.  Some of that stuff belonged to her."

Shields will be back in court in April.

His attorney is disappointed with the ruling and believes all charges except a misdemeanor assault should have been thrown out.

The district attorney disagrees, saying if the 9-year-old had not called 911, this would be a murder trial.

"I wouldn't be here today putting this case on if I didn't think we had the evidence to go forward," Harris said.

But Shields' attorney says the judge shouldn't put too much stock in the girl's story.  "That's the danger of talking to children," said Jim Linger.  "Many innocent people go to jail because people jump to conclusions."

Shields has had many run-ins with the law.

Authorities believe he was involved with the 2007 disappearance of a Tulsa woman named Angie Tucker, but he has not been charged in that case.
