A judge delayed the preliminary hearing for two Broken Arrow brothers accused of killing their parents and three siblings. Attorneys presented arguments to the judge about why the defense believes 16-year-old Michael Bever should not be tried as an adult.

Michael Bever and 18-year-old Robert Bever are charged with first-degree murder in the July deaths of their family at their Broken Arrow home.

Rob Nigh, the attorney for Michael Bever argued that his client has been denied the chance to be classified as a juvenile delinquent or youthful offender under Oklahoma's juvenile code.

The brothers have pleaded not guilty.

The preliminary hearing has been rescheduled for January, 2016.
