A pizza delivery driver who was attacked on Friday morning thought she knew who attacked her, but police say, she made a mistake.

One of the suspects’ mothers, who we're not identifying, says she knew it wasn't him, because he has an alibi.

Emmitt Sam, 17, is in the Tulsa County jail accused of a weekend crime spree that includes carjackings, a home invasion and even a murder. But police say he will not be charged with assaulting a pizza delivery girl.

Renee fought off attackers Friday at 1 a.m., and after she saw Sam's picture on TV, she thought he and his buddy, were the ones who did it.

She said they were young, wearing the same clothes and Sam had a mark on his face from her fighting back.

But after a thorough interview with police, officers believe she made a mistake.

Sam's mother says there's no doubt it wasn't her son, because he watched movies with her until 2 a.m., then he sat up talking with his grandma and was asleep on the couch at 5 a.m. and had no marks on his face on Friday.

"I'm sorry for the victim if she was assaulted, but I know that it was not my son who did it,” his mother said.

Even though she can't give an alibi her son for the next night, she wonders if a mistake also was made about the other crimes he's accused of and says there are many unanswered questions.

"What else could he have not have done?” she said.

She says her son will be a senior at Nathan Hale High School, loves soccer, is outgoing and has only been in trouble once before, for a fight, but he got probation and is getting counseling.

"I know he couldn't take somebody's life,” she said. “He does have a heart of gold."

Even though Emmitt's mother believes in her heart her son couldn't take a life, she said she understands she has to let the process take its course.
