Officer Betty Shelby's Defense Wants Second Gun Tested In Crutcher Shooting Case

Attorneys for the police officer who shot and killed Terence Crutcher have asked a judge to order a forensic exam of a firearm they say Crutcher used the day before his death.

The attorneys filed a motion Tuesday on behalf of Officer Betty Shelby, saying they've confirmed witness reports that Crutcher "was walking down the street firing the gun" that day.

They say Crutcher was also seen pointing the gun at someone the night before he was killed.

The motion asks the judge to order the Tulsa Police Department or another forensic laboratory to examine the gun, its magazine and any bullets it may have for fingerprints and DNA and to compare them to those of Crutcher's.

Officer Shelby is charged with 1st-degree manslaughter in the death of Crutcher on the evening of September 16, 2016. Shelby was responding to another call when she encountered Crutcher's SUV parked in the middle of the street. 

The motion filed on November 1, 2016 says Shelby received a phone message on or about September 28 from a man describing Crutcher as the person who was firing a gun "on the Northside" on September 15, 2016.

The motion said the caller stated police were called and a report was filed. When the caller described the location, he said it happened at "15th and," but the name of the cross street was inaudible, according to the motion.

Last week, Shelby's attorneys filed a motion asking for permission to examine Crutcher's SUV.
