The grandparents of a 2-year-old Tulsa boy filed a lawsuit against Oklahoma's DHS and Family and Youth Intervention Services.

Rick and Cindy Rigny claim negligence after the death of their grandson Michael Rigny earlier this year.

Police said the little boy died after he was kicked in the face by his mother's boyfriend, Branden Taylor.

The lawsuit says both agencies failed to properly investigate reports of abuse, which contributed to the boy's death.

Taylor is being held without bond for child abuse murder.

The boy's mother, Tina Morgan, is accused of permitting child abuse.
