Court To Hear DOC Request To Drop Lawsuit Filed By Amber Hilberling's Estate

<p>The Department of Corrections is trying to get a lawsuit dismissed as the estate of Tulsa resident Amber Hilberling claims they didn't do enough to prevent her death.</p>

The Department of Corrections wants a judge to dismiss a lawsuit filed against it by the estate of Tulsa resident Amber Hilberling.

Hilberling hanged herself in 2016.

Her estate sued DOC saying it failed to keep her safe. The judge is expected to decide Thursday whether to dismiss the case or allow it to proceed.

Hilberling was serving 25 years for pushing her husband out of a high rise apartment window. Her estate claims other inmates were the ones who found her, not the prison staff.

Her estate also argues the prison knew she was suicidal but didn't do anything about it and failed to protect her from a predator inmate who extorted and manipulated Amber.

The DOC hasn't commented, citing the ongoing litigation, but its motion says the lawsuit is unclear on the allegations and doesn't provide enough facts for the prison to defend itself.

The hearing is taking place in an Oklahoma County courtroom.
