An Oklahoma County judge has scheduled a Feb. 5 preliminary hearing for a man accused in the stabbing death of his father, Oklahoma's labor commissioner.

An Oklahoma County judge has scheduled a Feb. 5 preliminary hearing for a man accused in the stabbing death of his father, Oklahoma's labor commissioner.

Special Judge Lisa Hammond scheduled the hearing Tuesday for 27-year-old Christian Costello. Costello's charged with first-degree murder in the death of 59-year-old Mark Costello.

The preliminary hearing will determine whether a crime was committed and whether there is probable cause Christian Costello committed it.

Prosecutors say Costello attacked his father with a knife and repeatedly stabbed him on Aug. 23 at an Oklahoma City restaurant. A judge has entered a not guilty plea for Costello.

His family says he suffers from mental illness and court records show he's been in a mental health facility. Defense attorney Bob Ravitz says a private psychiatrist is examining Costello.
