Michael Bever Attorney Raises Question Of Client's Mental Status

The lawyer for a Broken Arrow boy accused of killing his family filed a notice of intent to raise the question of his client's mental status. Michael Bever has pleaded not guilty to five counts of first-degree murder in the killings of his parents and three of his siblings. 

That notice may allow his attorney to use the insanity defense. Michael Bever, who is being defended by attorney Rob Nigh, is scheduled to go to trial next June.

"Counsel candidly informs the Court and the State that we are still evaluating Mr. Bever's mental illness at the time of the alleged offenses, and if it becomes apparent that a mental illness or insanity defense cannot be supported this notice will be withdrawn," Nigh said in the filing.

Older brother Robert Bever is serving life without parole after pleading guilty to the same charges.
