Medical Marijuana Activists To Challenge Broken Arrow Regulations

Activists say they plan to challenge Broken Arrow 's medical marijuana regulations after the city council approved the new rules Tuesday evening.

During a meeting, the city council unanimously passed new regulations regarding zoning and licensing of dispensaries.  Some of the rules include prohibiting dispensaries within 1,000 feet of a school or setting up shop in a house.

The city says commercial businesses will have to pay an annual fee of $2,500 to operate in the city.

A lawyer says the new rules are cost prohibitive.

"They're taking patient's medicine away from them, they're making them cost-prohibitive for them to get and we're not going to stand for it," said Attorney Ronald Edward Durbin.

"It's no different than a city regulating where a pharmacy would go or where it makes sense for a liquor store to go and so the City of Broken Arrow has adopted regulations that make sense for our community," said Broken Arrow City Attorney Trevor Dennis.

Broken Arrow says the permit process starts Wednesday and the first permits will be issued on October 1st.  To apply, you can stop by the north end of City Hall at 220 South First Street or if you have questions, call the city's One Stop Center at 918-259-2411.
