Man Shot By Rogers County Prosecutor To Stand Trial

A man shot when deputies say he broke into an assistant district attorney's home is headed to trial.

A judge ruled Wednesday there is enough evidence  to try Bryan Starkey.

Former judge and Craig County Assistant District Attorney Erin Oquin shot Starkey on December 10, 2015 and testified against him on Wednesday.

Deputies say Starkey broke into her home just outside of Inola that morning. 

Investigators believe he broke into two other homes nearby before making his way to Oquin's, where she says he kicked the door open.

She talked with us in December and said when she saw the door splinter and slam open, she knew she had to make a choice.

"I will tell you, the sound of him kicking the door was far worse than the gunshot," she said.

Oquin shot Starkey once near the neck before he ran off. Deputies arrested him just a mile from her home. 

Starkey's lawyer grilled Oquin about the details of that day. Oquin maintained she feared for her life, a sentiment she shared back in December. 

"I've never been so scared in all my life. It does seem like everything slows down, but it's only a matter of seconds you have to make a decision."

She says she doesn't feel guilty over her choice, but for Starkey's. She says she forgave him before he even left her home. 

Starkey is scheduled to go to trial in May.
