A Tulsa County judge threw out a man's conviction and sentence for his role in a deadly crash that killed three members of a family on Christmas Eve six years ago. Steven Jameson's attorneys asked the judge for a review after they learned of a possible error in the case.
The district attorney plans to appeal the judge's ruling over the three first-degree manslaughter convictions being vacated.
The hearing before Judge Caputo last all afternoon.
Steven Jameson pleaded guilty to three counts of manslaughter and unlawful possession of a controlled drug in 2011. The 2009 Christmas Eve crash killed three people: Michael Mulanax, 42, his wife Angela, 41, and their son James Mulanax, 18.
Jameson's attorneys filed an appeal to argue their client didn't receive the proper sentence four years ago when Jameson pleaded guilty.
Jameson's attorney's claimed there was another more recent law on the books that should have been considered, but his former lawyer didn't provide it to him.
Jameson's mother is pleased with the judge's decision.
"He's very relieved," Debra Jameson said of her son. "He's obtained two college degrees while he's been incarcerated, and he wants to go to law school. He sees the need to help, and I think he'll accomplish that once this is behind him."
The Mulanax family is confident the district attorney will continue to fight the case.
"It was not the best news we wanted to hear," said Linda Perkins, grandmother. "What we heard stated in the courtroom proved to us that there were no grounds for an appeal for post-conviction appeal, and I felt that Mr. Kunzweiler presented that - documented it well."
District Attorney Steve Kunzweiler says he will appeal the judge's decision. Jameson is due back in court later this month and will remain in jail.
Jameson's attorney, Clark Brewster, said he will defend Jameson in an appeal.
