Former Oklahoma Family Frustrated Over Postponements Of Child Neglect Case

<p>Recently, a child neglect case more than two years old was postponed again, not for a month or two, but for seven months away.</p>

When two-year-old Olyvia Dettman came home from daycare with bruises and scratches, police arrested the daycare owner.

That was more than two years ago and the trial has been postponed repeatedly. Recently, it was postponed again, not for a month or two, but for seven months away.

Olyvia's family is beyond frustrated and wants answers.

On September 22nd of 2012, Olyvia had bruises and scratches on her after being at the Mother's Love Babysitting Daycare.

Prosecutors charged the owner of the daycare, Chelsea Day, with child neglect and two counts of running a daycare without a license.

A trial date was set and canceled over and over.

"It's not right and nobody in this case is getting justice,” said Olyvia's grandmother, Micki Dettman.

Most recently, the trial was set for September 22nd.

The entire family now lives in Illinois so they all took time off work, bought airline tickets and made hotel reservations, then a flood at the Tulsa County Courthouse basement put all trials on hold.

The judge reset Day's trial for April 13th, which is seven months away.

"I'm not even asking for it to be reset for the next month, but seven months away is not reasonable. There's something wrong with that picture,” Dettman said.

She said Olyvia's parents are now the proud parents of a little boy and are planning on getting married in June, a date they picked because they thought the trial would be long over.

She's afraid if the April date gets postponed, it will fall during the wedding, where they've made down payments and reservations.

"You just feel like you're being victimized over and over again,” Dettman said.

Judge Jim Caputo said when rescheduling trials he does the most serious crimes, like murder, first and he also does those people who are sitting in jail waiting on a trial before people who are out on bond.

Chelsea Day's charges are non-violent and she's out on bond.
