A judge dismissed a lawsuit Monday against a Tulsa oral surgeon accused of keeping unsanitary conditions at his clinics in Tulsa and Owasso.
Sharon Fairchilds and her daughter filed the lawsuit in April, alleging Dr. W. Scott Harrington was negligent when he allowed two of his office clerks to perform sedation on the daughter.
Harrington's attorneys had asked that their lawsuit be dismissed.
At a hearing Monday, the judge dismissed the suit when the Fairchilds failed to show up for the hearing.
The Tulsa City-County Health Department says 89 of Harrington's former patients tested positive for hepatitis C.

The dentist has been sued by a number of patients, accusing him of unsafe and unsanitary practices and possibly exposing them to disease.
