A Tulsa County judge has denied a grand jury petition filed September 13, 2013, to investigate the 2012 drowning death of a Sand Springs 19-month-old.
In an order filed Tuesday, Judge William Kellough stated the petition was "sufficient in part and insufficient in part."
Gary Schooley stated in his petition to impanel a grand jury, that his aunt, Nita Teague, "failed to provide proper supervision," of his daughter, "by not monitoring her properly."
Schooley also sought to have the Tulsa County District Attorney's Office disqualified as the panel's legal advisor. Judge Kellough said he found "no actual or apparent conflict of interest" by the DA's office.
The judge also stated allegations in the petition were vague and "there legally insufficient."
