The father of a toddler wants a grand jury to investigate his daughter's drowning death in Sand Springs in 2012.

Gary Schooley states in his petition to impanel a grand jury, that his aunt, Nita Teague "failed to provide proper supervision" of his 19-month-old daughter "by not monitoring her properly."

Schooley also states in his petition, the Tulsa County District Attorney's Office's "decision to refuse to file a charge of "child neglect, second degree murder or second degree manslaughter" against Nita Teague. Because of the latter complaint, Schooley wants the DA's office to be disqualified as legal advisor to the grand jury.

The Sand Springs Police Department said on March 27, 2012 police and firefighters were sent to a home in the 1300 block of North Northridge Court on a drowning report.  At the home they found a neighbor performing CPR on Gracie Schooley next to a small koi pond.

The toddler was taken to the hospital, where she was declared dead.
