Trial Begins For Dewey Man Charged With Murdering Toddler

Testimony has begun in the murder trial of a Dewey man charged with the death of a toddler in February 2012.

A jury was seated in Washington County court on Monday, January 28, 2013.

Marcus Mitchell is charged with first degree murder in the death of 15-month-old Emma Beth Warmberodt.

The state's first witnesses were emergency personnel who were first on the scene, telling the court that it was obvious the toddler had been dead long before they got there.

Agents with the Oklahoma State Bureau of Investigation testified they found marijuana and oxycodone in a bedroom shared by Marcus, his wife Ashley Williamson Mitchell and the toddler, Williamson Mitchell's daughter.

Williamson Mitchell entered a blind plea January 25, 2013 to child neglect and enabling child abuse. Her sentencing is set for April 3, 2013.

Mitchell's mother, Juanchelle Fitch, who also lives in the home, waived her jury trial on Friday and is scheduled to enter a plea on February 6th. Fitch is charged with being an accessory after the fact.

The state has stated it could call as many as 20 witnesses in the trial.
