Judge Allows Occupy Tulsa Protestors To Move Forward With Jury Trial

Occupy Tulsa protestors accused of violating the city curfew claim police used excessive force and have been granted a jury trial.

A jury trial is the next step for a group of Occupy Tulsa protestors accused of violating the city curfew.

A municipal judge made that ruling late Thursday afternoon.

The group is fighting the charge following their arrests last November.

At the time of their arrests by Tulsa Police, several of the protestors accused police officers of using excessive force and pepper spray to clear out downtown park were they were demonstrating.

Protestors say their Constitutional rights trump a city curfew ordinance.

"I think the decision here today by the judge was misinformed," Samuel Molik, Occupy Tulsa Protestor. "It think that he is... seems like a reasonable guy, but the city attorney was definitely misleading in the way in which he dealt with the defense hearing motion."

The Occupy Tulsa protestors will plan their next move with their lawyer.

A trial could take place as early as July.
