BROKEN ARROW, Oklahoma -- The widow of a Broken Arrow man who was shot and killed by a Broken Arrow Police officer in 2009 has filed a wrongful death suit in Tulsa County District Court.

According to court documents, Ruth Samuel, the wife of 29-year-old Nathan Samuel filed the lawsuit last week.

On October 6, 2009, Broken Arrow Police say an officer was called to a home at 36th Street and 209th East Avenue on a report of a two people fighting in the front yard.

Police say Officer Stephen Garrett was the first on the scene and Nathan Samuel came out of the house wielding a knife.

Police Major Carole Newell says Officer Garrett shot Samuel after repeated commands for Samuel to put down the weapon.
