HUGO, Okla. (AP) -- A federal appeals court is upholding the ruling that a southeast Oklahoma rancher deserves a new trial on a murder charge. Fred Holder of Hugo was convicted and sentenced to 14 years in prison for second-degree murder in the 1999 death of David Pickens during a land dispute.
A federal judge in Muskogee ordered a new trial after finding that Holder's trial attorney was ineffective.
Prosecutors appealed that ruling but the 10th Circuit Court of Appeals in Denver voted 2-1 to uphold the order for the new trial.
