ATLANTA (AP) -- NASCAR has earned a victory in its logo battle with AT&T Incorporated.
A federal appeals court has ruled that NASCAR may prevent AT&T from featuring its logo on Jeff Burton's number-31 Chevrolet. The court said Monday that AT&T lacks standing to challenge NASCAR's decision to ban the logo.
AT&T rival Sprint Nextel Corporation sponsors the Nextel Cup series.
The court threw out a lower court's ruling that prevented NASCAR from stopping AT&T's plans. The appeals court remanded the case to the U.S. District Court in Atlanta for dismissal.
AT&T had wanted to change the Cingular logo on Burton's car after buying BellSouth Corporation last year and gaining full control of Cingular. It has since rebranded the cell phone provider under the AT&T name.
