OKLAHOMA CITY (AP) -- A lawyer for former state Senator Gene Stipe asks a Denver federal appeals court to determine if a federal judge went too far in sending his client to a federal prison hospital.
Attorney Clark Brewster argues in a few filing that the judge in the case jeopardized Stipe's health and endangered his life by sending him to the facility to have his mental competency evaluated.
The lawyer didn't elaborate on how Stipe's health was put at risk.
Brewster also told the 10th U.S. Circuit Court of Appeals that evidence used when the judge subsequently declared Stipe incompetent was improperly obtained.
U.S. Attorney Sheldon Sperling says he thinks the factual basis for the appeal is frivolous.
