The News on 6 has learned the case against a suspect in Scott Bolton's death is sitting on the Tulsa County District Attorney's desk right now.
News on 6 crime reporter Lori Fullbright says court affidavits give us our best look yet at what happened that night and we learn Scott Bolton was killed, not because of anything he did, but because he was helping out a friend.
The affidavit says Scott Bolton and a friend went to Club 54 on September 11th and after a disturbance, the friend was told to leave. Bolton walks with the friend to a parking lot in order to drive him home.
The documents say four men followed, Adam Buchert, Jason Nicholson, Doug Johnson and Charles Spicer. It says the men had words with Bolton and his friend and someone punched Bolton one time, he fell, hit his head on the concrete and later died. But when police called the four men, records say they hired lawyers, refused to give interviews and said they'd plead the fifth if subpoenaed to testify.
Tulsa Police Sgt Mike Huff: "With this lack of cooperation, we're wasting weeks of manpower and there's no reason for them not to cooperate except they want to assist a criminal."
Detectives believe the man who threw the fatal punch has fled to Kansas City. The DA told police he wants more information before approving the charges against that man. The problem is, some of the witnesses have also fled the state and with no one willing to talk, who knows if or when charges will be filed.
That's hard on Bolton's family.
