(Detroit-AP) -- The verdict's still out on whether a libel lawsuit filed against filmmaker Michael Moore by the brother of Oklahoma City bombing conspirator Terry Nichols should be thrown out.

James Nichols claims Moore tricked him into appearing in the Oscar-winning 2002 documentary "Bowling for Columbine."

James Nichols also contends Moore libeled him in the film by linking him to the 1995 bombing that killed 168 people.

Moore is accused of libel, defamation of character, invasion of privacy and intentional infliction of emotional distress.

James Nichols is seeking a jury trial and damages ranging from $10-million to $20-million on each of nine counts.
