(Oklahoma City-AP) -- State Insurance Commissioner Carroll Fisher says he won't testify before a special legislative committee that is considering his impeachment.
The Oklahoman reports Fisher has signed a notice saying he would invoke his 5th Amendment right and not make statements that would incriminate himself.
Fisher special assistant Opal Ellis has also refused to testify before the panel in August.
She says she is declining because of the serious nature of the charges against her.
Fisher and Ellis face embezzlement charges including a charge that accuses Ellis of putting about six-thousand dollars in a continuing education fund in her personal checking account and keeping three-thousand-390 dollars.
Their preliminary hearing is in Oklahoma County District Court.
