Embattled Booker T Washington band director Elmer Davis Junior has been fired.

The Tulsa School Board unanimously decided to terminate Davis at a hearing Tuesday night. Several students accused him of sexual misconduct. They claim Davis made sexual comments to them and inappropriately touched them.

Davis' attorney says the claims were exaggerated and that his client was never given a fair hearing. Richard O'Carroll, â€œhe represents 30 years of prestige for Booker T. Washington and he will not go down without a fight, and I sincerely believe he won't go down at all."

O'Carroll says he'll take the case to district court to try to get his client's job back.

The school district maintains Davis needed to be removed from the classroom.
