A Tulsa County District Court judge dismissed a deadly case of road rage Wednesday, after the only witness to the accident says he forgot what happened.
19-year-old Nicholas Horath faced manslaughter charges for an accident police say he caused. Wednesday, a judge set him free.
Family members of 17-year-old Alana Merchant had hoped a witness who originally saw the accident on Highway 75 last July would tell the judge he saw Horath swerve in front of the car Alana was riding in. An action that forced Alana's friend, who was driving the car, to swerve into a tractor-trailer, killing Alana.
Charges could be re-filed later.
